§ 1 scope

For the business relationship between the STMR-BRACELETS platform and the customer for orders in the online shop, the following general terms and conditions (GTC) apply exclusively in the version valid at the time of the order. Please read the terms and conditions carefully before placing an order in our online shop.

Our offer in the online shop is aimed exclusively at consumers with residence and delivery address in one of the following countries:

Switzerland / Lichtenstein / Germany / Austria / Italy / Belgium / Great Britain / France / Ireland / Monaco / Norway / Sweden / Spain / Czech Republic and Portugal.

We only accept orders from customers who have reached the age of 18 at the time of the order.

All correspondence in connection with these terms and conditions is processed via STMR-BRACELETS, Papieri-Ring 5, 6330 Cham or kontakt@stmr-bracelets.com.

§ 2 payment entitlement

In order to be able to make payments in the online shop, you must provide your personal data. It is imperative that you provide your correct name, phone number, email address, and other required information. In addition, when ordering the products, you will be asked to provide the payment information correctly and to guarantee that it is correct and valid. You confirm that you are the person who is specified in the billing information.

The online shop is only available to people who meet the requirements of STMR-BRACELETS, who have a valid credit card and who have authorized STMR-BRACELETS to charge their credit card for the purchase amount of the products purchased.

If STMR-BRACELETS considers it necessary, information about you will be transmitted or obtained by third parties. This may include information about your credit card number or credit information, in order to confirm your identity, to validate your credit card, to obtain a first credit card authorization and to allow your individual payment transactions.

The personal information you provide may be shared with one of our payment processing partners, a credit reporting or fraud prevention agency, which in turn may keep a record of this information.

You may not use STMR-BRACELETS if:

• in a manner that is capable of interrupting, damaging or otherwise impairing access to STMR-BRACELETS or
• for fraudulent purposes or in connection with a crime or illegal activity.

Furthermore, each user is obliged to refrain from publishing content or transmitting messages, the or their setting

STMR-BRACELETS reserves the right to prohibit access to and use of the website, to close user accounts (member accounts) or to remove or change content if it violates applicable laws, these terms of use or other applicable contractual terms or guidelines. Furthermore, STMR-BRACELETS can be found on social networks (Facebook, Twitter, LinkedIn, Instagram, etc). delete published comments and posts at any time without reason and without notice. When evaluating orders, only truthful and factual information that does not contain abusive criticism may be given.

§ 4 Orders / Prices / Payment / Delivery / Returns / Warranty etc.

ORDERS

Our website and our online shop are merely an invitation to the customer to submit offers to conclude a purchase contract for the products presented. All orders are subject to availability and our acceptance.

STMR-BRACELETS offers products that are specially made by hand after order. It may happen that due to production problems or quality controls we cannot deliver some products at the time of your order. If this happens, we will contact you immediately by e-mail and credit the credit card for the originally charged amount within 30 days after confirmation of the non-deliverable product.

PRICES

The prices listed on the website are in the currency shown (excluding statutory VAT -> our company is not subject to VAT)

ACCEPTING YOUR ORDER

As soon as you have made your selection, collected it using the "Add to shopping cart" button and your order has been sent, this constitutes a binding offer to purchase the products in the shopping cart.

You will then receive an email with the order confirmation. This email is NOT an order acceptance but only a confirmation of the receipt of your order.

The order acceptance and the conclusion of the contract between you and STMR-BRACELETS are deemed to have taken place as soon as we send you an email with the order confirmation. The purchase contract is concluded in Zug (Switzerland) and the language of the contract is German.

We reserve the right to reject the order at our own discretion. We are not liable to you or third parties due to our revocation. In particular, we cannot accept the order for the following reasons: (1) In the event of non-authorization of payment; (2) for a product that is not in stock or does not meet our quality control standards and must therefore be withdrawn; (3) They do not meet the criteria set out in the terms and conditions.

SHIPPING INFORMATION

All shipments are carried out by Swiss Post. They cannot be delivered to mailboxes. The General Terms and Conditions of Swiss Post Ltd apply in addition and can be accessed at: www.post.ch

DELIVERY TIME

Estimated delivery times: 2-5 working days in Switzerland + Lichtenstein and 5-8 working days for other destinations within Europe.

The expected delivery times are to be seen as a guideline and start with the receipt of the order. We accept no liability for delays in delivery.

The transfer of risk commences from the moment you receive the products.

SHIPPING

The delivery is carried out by Swiss Post AG as standard shipping without tracking number and without insurance.

The shipping costs are listed during the online check-out and payment process. The following generally applies to our shipments:

Switzerland & Lichtenstein: The delivery time is approx. 2-5 working days after receipt of your payment. Deliveries within Switzerland are free of charge

Germany / Austria / Niderlande + Italy: The delivery time is approx. 5-8 working days after receipt of your payment. Deliveries from an order value of CHF 150.00 are free of charge (for orders under CHF 150.00 the delivery costs are CHF 10.00).

Belgium / Great Britain / Ireland / Monaco / Norway / Portugal / Sweden / Spain + Czech Republic : The delivery time is approx. 6-8 working days after receipt of your payment. Deliveries from an order value of CHF 150.00 are free of charge (for orders under CHF 150.00 the delivery costs are CHF 10.00).

PAYMENT METHODS

We only accept the payment methods shown to the customer as part of the ordering process (advance payment via bank transfer (eBanking), credit card payment via PayPal or Twint within Switzerland). When paying by credit card, the corresponding amount will be debited after STMR-BRACELETS has sent your order. With the payment you confirm that the credit card used belongs to you or that you have a specific authorization from the holder. All credit and debit card holders are subject to validity checks and authorization from the card issuer. If the issuer of your payment card refuses to pay STMR-BRACELETS, we are not liable for delays or non-delivery of the product.

We do everything we can to make our website as secure as possible. All credit card transactions are processed through PayPal, an online payment portal that encrypts your card details in a secure database environment. If you are a registered user, we will keep your credit card details securely in our system. These details are fully encrypted and are only used for your card transactions.

RETURNS

Basically, a return is only possible 14 days (calendar days) after receipt of the goods. The date of the postmark or the delivery of the pick-up invitation is decisive. After this period, a return is no longer possible. We recommend that you check the item immediately upon receipt and send it back immediately if you wish. The following conditions also apply: (1) The item is undamaged and unworn, (2) The item is in undamaged original packaging, (3) Any accessories supplied are fully available.

If all of these conditions are met, we will refund the purchase price paid.

In general, the shipping costs for the return of unwanted items are to be borne by the purchaser or sender. If one of the following conditions applies, the shipping costs will be borne by STMR-BRACELETS: (1) item does not correspond to the order, (2) incorrect information / s on STMR-BRACELETS, (3) received defective item, (4) received incomplete product .

The item must be packed securely for return by the customer. The return of an item must be in its original packaging and complete, along with all accessories. Wrong information given by the customer about the bracelet size (measured incorrectly) is no reason for a return (therefore please measure exactly).

FAULTY PRODUCTS / FAILED DELIVERIES

Please check the products we have received for errors immediately upon receipt. Products are faulty if they arrive damaged or have a material or manufacturer defect. Commercially available or technically unavoidable, material-related deviations in the quality, color, size or design of the product do not constitute defects. This also applies to natural wear and tear.

EXCHANGE

We generally do not offer an exchange right. However, you can make use of the right of return (cf. chapter "Returns").

WARRANTY (STANDARD)

We grant a warranty period of 6 months from the date of purchase on our products. This includes a possible tearing of the rubber band, fallen out zirconia stones and possibly breaking the stone beads.

Errors or defects due to external influences, the use of care products, chemicals or improper use (bathing / showering / sports etc.) or storage are not covered by the guarantee! In the event of a warranty claim, the bracelet must be returned to STMR-Bracelets at the customer's expense. STMR-Bracelets only takes over the postage for the return to the customer.

The two fee-based warranty extensions (to 12 or 18 months) include the same coverage as the standard warranty.

If spare parts from STMR bracelets are no longer available during the warranty period or warranty extension, the bracelet will be replaced by a new / available bracelet of the same purchase value.

Warranty claims must be made in writing to "kontakt@stmr-bracelets.com".

STMR-BRACELETS VOUCHERS

At STMR bracelets, you can obtain electronic vouchers with a value of CHF 20.00, CHF 30.00, CHF 50.00 or a value of CHF 100.00. These are valid for 6 months from the date of purchase. After purchase, you will receive an electronic voucher from us by email as a PDF (see web shop) with a discount code of the purchased value. You (or the recipient) can enter this code when checking out on STMR-BRACELETS and thus redeem the voucher amount. The full voucher amount must be used in one go (no refund of remaining credit). The voucher code can only be used once and cannot be distributed to different orders. If the voucher is not redeemed within 6 months of the purchase date, the voucher and the corresponding amount will expire (no right to reimbursement).

§ 5 colors

We endeavor to reproduce the colors of the products as accurately as possible on our website. However, since computer screens have different screen resolutions, we cannot guarantee that your screen resolution will accurately reproduce all colors. Since we mainly use natural stones to manufacture the bracelets, it may be that the pattern of the stones differs slightly from the illustration in the online shop.

§ 7 Changes to the general terms and conditions

STMR-BRACELETS reserves the right to change these terms and conditions at any time and without giving reasons. The customer is subject to the terms and conditions that are in force at the time the customer uses STMR-BRACELETS.

As part of the ordering process, the customer only agrees to the STMR-BRACELETS - GTC and the GTC of the respective shops mentioned in the ordering process. No other conditions apply.

§ 8 No waiver

If the customer violates these terms and conditions and STMR-BRACELETS does nothing against this, this does not constitute a waiver of the rights of STMR-BRACELETS. STMR-BRACELETS is further entitled to exercise their rights on any other occasion in which you violate these terms of use close.

§ 9 Applicable law and place of jurisdiction

Swiss law applies to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction, subject to any statutory places of jurisdiction, is Zug.

A violation of these terms and conditions (including the data protection declaration) can lead to the loss of membership and access to STMR-BRACELETS.
